DrinkSpot.com.au is an online ordering platform for independently operated licenced liquor stores.

As a condition of using this website, you agree to comply with and be subject to all of the following terms and conditions of use.

Liquor Licence

Your contract of sale is with DrinkSpot PTY LIMITED, Liquor License number No. LIQP770018335 as the liquor is sold by the holder of that Liquor Licence using the DrinkSpot Technology platform. Accordingly, the sale of liquor pursuant to an offer to purchase from this website is made at the licensed premises attached to the applicable Liquor License.

Victoria

Warning - Under the Liquor Control Reform Act 1998 it is an offence: To supply alcohol to a person under the age of 18 years (Penalty exceeds $19,000), For a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $800).

For sales made in Victoria, the sale of liquor pursuant to the offer to purchase from this website is made at our licensed premises attached to the licence numbers listed below. Your contract of sale is with the Licensee listed above as the liquor is sold from our website by our licensee on behalf of the Licensee. Accordingly, your offer to purchase is subject to acceptance of your offer by the holder of the liquor licence, certification and evidence of you being over 18 years of age, the availability of stock and the liquor which is the subject matter of your offer being ascertained and appropriated at the above-mentioned licensed premises.

South Australia

Under Liquor Licensing Act 1997, Liquor must NOT be supplied to persons under 18.

For sales made in South Australia, the sale of liquor pursuant to the agreement to sell from this website is made at our licensed premises attached to the licence numbers listed above. Your contract of sale is with the Licensee of that Liquor Store as the liquor is sold from our website by our licensee on behalf of the Licensee. Accordingly, your offer to purchase is subject to acceptance of your offer by the holder of the liquor licence, certification and evidence of you being over 18 years of age, the availability of stock and the liquor which is the subject matter of your offer being ascertained and appropriated at the abovementioned licensed premises.

For deliveries to South Australia, If you are in SA, you agree that: (a) on delivery, the person accepting delivery will be required to (i) sign a declaration confirming their name and that they are over 18 years of age, or (ii) if the recipient looks under 25 (at our discretion), provide proof of ID (including photographic identification and date of birth) and the name and date of birth of the recipient will be recorded; and (b) we are instructed by you, the customer, to deliver the product to a person at the delivery address provided they meet our other delivery requirements. Information collected and recorded under this requirement will be held for a minimum of 12 months. These are requirements of South Australia's Liquor Licensing Legislation and will apply from 1 July 2019, and if the person accepting delivery is unable to comply, we will not be able to complete the delivery and your order will be cancelled.

Western Australia

WARNING. Under the Liquor Control Act 1988, it is an offence: to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises; or for a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises.

For sales made in Western Australia, the sale of liquor pursuant to the agreement to sell from this website is made at the licensed premises attached to the licence numbers listed above. Your contract of sale is with the relevant Licencee at the relevant premises from which you order is accepted and fulfilled. Liquor is sold from our website on behalf of the relevant Licencee. Accordingly, your offer to purchase is subject to acceptance of your offer by the holder of the liquor licence, certification and evidence of you being over 18 years of age, the availability of stock and the liquor which is the subject matter of your offer being ascertained and appropriated at the above mentioned licensed premises

Responsible Service of Alcohol

DrinkSpot and its licenced Partner stores takes the responsible service of alcohol very seriously. If you, the customer, look under 25 and are unable to present valid photo identification, your order will be cancelled. If anyone present at the delivery premises at the time of delivery looks under 25 and is not able to present valid photo identification, your order will be cancelled.  If you, the customer, show signs of intoxication either when placing your order or at the time of delivery, your order will be cancelled. Alcohol cannot be left unattended for any reason at any time. We reserve the right to refuse service at our sole discretion, this may be because of our concern for a customer's welfare and our commitment to responsible service in the community.

Cancelled Orders

If your order has been cancelled because you cannot present valid photo identification or you are intoxicated, your order will also be refunded, except for the delivery fee, which will be charged. If your order has been cancelled because you were unable to accept delivery because of an incorrect address or phone number, your order will be refunded, except for the delivery fee, which will be charged.

Defective Products

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

•          to cancel your service contract with us; and
•          to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. Delivery Policy:

Delivery. DrinkSpot strives to deliver orders as per your chosen delivery timeframe. Delays can occur if products are out of stock. If items need to be orderred in, delivery timeframes will be longer. 

1. Customer Service.Our customer service staff are available to update you on your delivery during business hours.
2. Delivery Regulations. Due to licensing regulations we are unable to leave orders on your doorstep or at any other address other than the customer listed on the order
3. Customers must be able to present valid photo identification to receive their order.

Returns & Refunds:

1. DrinkSpot does not offer any returns or refunds on purchases unless damaged or incorrect items have been supplied.
2. If you are unhappy with your purchase, please contact DrinkSpot via email or live chat during business hours.
